They are the legal representative, the director and the coordinator of an entity that had an agreement with the Colombia’s Child Protective Services (Instituto Colombiano de Bienestar Familiar (ICBF), for the care of minors who are victims of sexual abuse in Valledupar.
Members of the Technical Investigative Corps (Cuerpo Técnico de Investigación (CTI) carried out the arrest warrant of the three people in the city of Valledupar (Cesar) for the alleged commission of sexual crimes against a minor.
The detainees, the legal representative, director and coordinator, allegedly forced a minor to witness her sexual relations and then they allegedly abused her.
The defendants are Rosa Virginia Laguna, her husband Rober Emilio Fernández Tovar and his brother Lenín José Fernández Tovar, who acted as the legal representative, director and coordinator, respectively, of a foundation that operated as a foster home a per an agreement with the ICBF, to provide protection and psychosocial support to children and adolescents who are victims of sexual abuse.
These people allegedly forced a minor to witness their sexual relations and it is believed that they abused her.
According to the investigations carried out by the Office of the Attorney General, there are more victims since the evidence and testimonies collected indicate that the defendants apparently took some girls out of the foster home to induce them, through pornographic videos, into sexual practices with them.
After the legalization of the home searches procedures and the arrests, a local prosecutor from Center for Integral Attention to Victims of Sexual Violence (Centro de Atención Integral a Víctimas de Agresión Sexual -Caivas in Spanish) charged them, according to their level of participation, with violent sexual rape in consistent sequence of serial crime. The preventive detention measure will be defined next Tuesday, November 16.
It should be noted that thanks to joint work with ICBF, during the operations it was possible the evacuation of minors who were in the foundation in order to restore their rights.
