The Office of the Attorney General, through the Special Investigation Unit (Unidad Especial de Investigación UEI in Spanish) achieved the prosecution of Daniel Olaya Álvarez, alias Nakar who allegedly ordered the murder of Ricardo Guevara Rodríguez (former Farc member in process of reincorporation). The facts took place on September 25, 2018 in rural area Tres Islas de San Miguel (Putumayo). 

In the hearings (audiencias  concentradas)*, the Attorney General´s Office charged the defendant with aggravated murder and aggravated criminal conspiracy. The defendant did not plead guilty to the charges. The supervisory judge issued a prison sentence that must be served in the prison of Pitalito (Huila). 

The evidence collected in the investigations shows that alias Nakar, the alleged leader of the Residual Organized Armed Group (Grupo Armado Organizado Residual Gaor) – Structure 48, known as ‘Los de Sinaloa’ or ‘La Mafia’, was in charge of the criminal expansion of the organization and would be responsible for several killings in the region.  

With this arrest, the Office of the Attorney General reaffirms its commitment to guarantying  justice in the post-conflict territories and to finding the truth about the illegal actions that endanger the integrity of people in the process of reincorporation, human rights defenders, indigenous communities, peasant, and social leaders. 

To date, 51.79% of the attacks committed against former Farc members in process of reincorporation and their relatives have been clarified. The Special Investigation Unit has obtained 38 guilty verdicts, 32 processes are in the trial stage and 31 are under investigation with a valid arrest warrant.
