Regarding the alleged irregularities in the so-called new cleaning model in Bogotá and due to failures in this service during the month of December 2012, the Office of the Attorney General informs that:

  1. Eleven (11) reports of events “noticias criminales” on this issue were received and have been solved through a single investigation.
  2.  As a result of this investigation, the case regarding  the offenses of execution of a contract without the legal requirements, undue interest in the executions of contracts, conspiracy and breach of duty which involved Gustavo Francisco Petro Urrego mayor of Bogotá; Diego José Fernando Bravo Borda, EAB former executive (in spanish Empresa de Acueducto de Bogotá EAB); as well as Henry Romero Trujillo, Uaesp former director (in spanish Unidad Administrativa Especial de Servicios Públicos  Uaesp) was closed.

This decision was made since there were not grounds to consider that offenses were committed during other events that were object of complaint. Such events are contract 017 between Uaesp and EAB, the issuance of Decree 564/2012, importation of car flatteners and the provisional authorization to use dump trucks for the garbage collection.

Likewise, the investigation regarding the alleged conspiracy of some private operators against the District Administration (in spanish Administración Distrital)  and the alleged irregularities concerning the return of these trucks by such operators was closed.

  1. As a result of this investigation, it was concluded that there are grounds to bring charges for the offenses of breach of duty against some public servants from the District Administration, particularly againts Uaesp former director, Nelly Mogollón Montañez, since she declared an emergency through Decision 768 dated December 17th, 2012 without fulfilling the condition of unpredictability as stipulated by law.  Also against Uaesp Legal Affairs Subdirector, Carlos Rojas Rivera, due to the imposed restrictions regarding free access to the so-called Doña Juana landfill. Detailed information about the case will be supplied in a hearing to bring charges (Audiencia de Imputación). This hearing will be requested once the worker´s strike is over.

According to what it was established, the imposed restrictions regarding  free access to this landfill would explain the collapse of the service in the month of December 2012.

  1. The Attorney General´s Office will have a copy attested in order to investigate Manuel Sánchez and Emilio Tapia for the offense of perjury due to serious inconsistencies in their sworn declarations on the alleged plot of private cleaning service operators.
  2. Likewise, the Office of the Attorney General determined that the non-collection of garbage in Bogotá during 18, 19 and 20 December 2012 did not cause environmental pollution according to the provisions of the Penal Code.
  3. Finally, it is considered as reasonable to continue with the appropriate investigations regarding the overruns and other possible irregularities in the purchase of vehicles and their maintenance in Aguas de Bogotá  company since the alleged irregular activities continue.
