Former mayor Samuel Moreno was summoned to appear before the Court as alleged responsible for the offenses of conspiracy, undue interest in entering contracts. The facts occurred between 2009 and the first half of 2010.
The indictment states that Moreno Rojas contacted Hector Zambrano Rodríguez, the Former Secretary of Health, to accept along with his brother Iván Moreno Rojas, several councillors, the District Ombudsman and the Comptroller ,a remuneration for the contract executed on 2009 between this Department and the company called Union Temporal Transporte Ambulatorio Bogotá.
According to investigations, it was estimated that the money received was the 9 percent of the total value of the contract signed by 67 thousand 200 million pesos, quantity distributed between Zambrano Rodríguez , Hipólito Moreno and the prosecuted people, and Emilio Tapia Aldana (contractor) and Federico Gaviria (businessman).
The Prosecution Authority considers that the principles of objective selection, responsibility and economy were infringed and that it will be corroborated with the introduction of 213 documents at trial, 75 witnesses and three expert witnesses.
” Moreno, without having full control over the act, was the person who created the idea in order to obtain an economic benefit, since he was aware of the meetings where the percentages to be paid by the beneficiary companies of contracts were negotiated ” said the prosecutor in charge of the case.
The conduct expressed in the indictment notes that Moreno committed a specific intent as he authorized, requested, controlled and received the benefits of the awards to contractors that interested him.
” The former mayor affected the legal right of the public administration, as he did not act with impartially, cleanliness , transparency and morality in his management and he acted without good cause ” states the indictment .
Moreno Rojas could be charged with a minimum sentence of 80 and maximum of 216 months in prison and ordered to pay between 66-300 statutory minimum wages fine. As Aggravating circumstances it shall be taken into account his distinguished position in society as well as his economic position.
However, the former president has no criminal records, fact that will be taken into consideration by the judge in case he pronounces a conviction.
