34 Bogota circuit penal judge rejected the defence request of the Bogota former Mayor, Samuel Moreno Rojas who requested the process nullity that is followed by contracting irregularities on the country capital constructions.
The judicial officer considered that it cannot speak of double imputation and there is no involvement of due process or defence rigth, as Moreno defense has claimed.
According to the judicial office decision, the facts by which the complaint was made to Moreno Rojas, were committed in different mode, time and place circumstances than the already charged Moreno in another process by the Office of the Attorney-General. This discretion coincides with the Attorney, who explained that it is not of the same facts, such as the letter of accusation puts it.
The decision of 34 judge of Bogotá circuit was supported by the victims defense, the IDU and the Comptroller General of the Republic, as the Public Ministry representative. On the defense appeal, the process was sent to the Bogota Superior Court.
