A Prosecutor assigned to the National Unit of Human Rights and IHL brought charges against Army Major (r) Carlos Andres Nivia Serrano for his alleged responsibility for homicide in protected person and conspiracy to commit crimes.
The investigation refers to what happened on September 26, 2005 in La Playa village, municipality of Barbosa (Antioquia), where Carlos Alberto Ospina Bedoya, villager of the area who was devoted to the agro job was killed. The victim was presented as an extortionist of the ELN guerrilla group, who was killed in combat between regular troops and members of said guerrilla group.
Statements and testimonies collected by a Prosecutor in charge of the investigation allowed to distort the theory of the armed encounter. Likewise, the non-commissioned officer Eneil Quiroz (already convicted) agreed to have been the perpetrator of the Ospina Bedoya’s death.
As established, Captain Nivia Serrano supposedly sent to Quiroz a package containing a battledress, a “Balaclava” and a revolver .38, items which were found on the victim.
The accused official (r) now is under custody.
