The force of evidences and definitive testimonies of the investigators, experts and specialists called in by the Attorney General Office during the trial, allowed to 27 Circuit Penal Judge in Bogotá, acting as Presiding Judge, pronounced conviction sentence against Raúl Muñoz Linares, former National Army second lieutenant, who was found responsible for the offenses of aggravated homicide in conjuction with rape.
Facts investigated by a Prosecutor of Human Rights and IHL are related to abusive sexual intercourse offense against a 13 years old girl committed on October 2, 2012.
Subsequently, on October 14, Muñoz Linares committed rape against Yenny Torres Jaimes, 14 years old, who was murder along with her brothers Jimmy Ferney and Jefferson Giovany, 6 and 9 years old respectively, in Caño Temblador, Tame rural area, Arauca department; region where the victims lived with their father.
As exposed by the prosecutor in charge of the case, Muñoz Linares outraged the kids, even after their death. This fact was proved during the oral trial based on the expert reports issued by the National Institute of Legal Medicine and Forensic Sciences.
“In a logical way, beyond every doubt, with evidences discussed in trial and based on assesment criteria that procedural law demand, it was proved the former military’s guilt “, affirmed the Presiding Judge.
The prosecutor insisted that Muñoz Linares is a “sexual depradator”, reason why the judicial official demanded the maximun punishment of 60 years in prison.”Muñoz Linares was hidden behind a tree during several minutes watching the home of the minors by binoculars before attacking them” affirmed the Prosecutor.
Finally, the judicial official confirmed that the conduct of the defendant was equivalent to a “sadist” due to his behavior against his victims.
Next September 18, the judge will pronounce the conviction that Muñoz Linares will serve.
