A Prosecutor belonging to the Prosecutor Office specialized in Human Rights brought charges against Jorge Eliécer Plazas Acevedo, a retired Colonel, for the aggravated murder of the comedian Jaime Garzón on august 1998.
The Attorney General Office reiterated a warrant of arrest and a Red Notice before INTERPOL on the above mentioned colonel who worked as Intelligence Head of the XIII Army Brigade at the time of the facts.
In other paragraph of the decision, the Prosecutor in charge of the process failed to declare the fact as a crime against humanity, as in principle, the crime does not comply with the requirement of “sistematicidad”* as stated at the Rome Statute. However, the Attorney General, Eduardo Motealegre Lynett said that the Attorney General Office or the judge leading the case can declare it as crime againt humanity if during the process appears evidence that proves that the crime was part of a systematic plan.
Plazas Acevedo has conviction for the offense of kidnapping and murder of the Benjamin Koudari.
*Sistematicidad: It refers to a repetition of a certain conduct.
