At the request of an Anti-Corruption Prosecutor, the 47 Criminal Municipal Judge in Bogotá, acting as Supervising Judge, has denied to set Isaias Robledo Robledo free, who was former prosecutor in Málaga municipality (Santander), based on a defense attorney’s petition for expiration of terms. Robledo is being investigated for bribery and procedural fraud.

During the hearing, the Prosecutor in the case proved in the court that even though, up to today, 388 days have elapsed since the bill of indictment was entered without having initiated an oral proceeding. It is because of the actions conducted by the defense attorney and, at any time, as responsibility of the Prosecutor’s Office.

The judge in his decision considered that, in effect, the delay is because of Robledo’s defense attorney and the 240 days ruled by law have not even elapsed.

As established in the investigation, the incident occurred in 2009, when the mentioned defendant had served as an Assistant of the Prosecutor, Section 300 of the Unit against Financial Offenses and Public Trust in Bogota and, with the purpose of receiving money from a complainant, Robledo promised to conduct a questioning to a person whose legal procedure had already been closed.

Likewise, Robledo took a dossier to a lawyer office, where he made a list of questions that apparently would be asked to a person in a new interrogation, presumably in that way, acting irregularly and infringing the law.

It also said that the defendant provided information through photocopies to the alleged victim.
