Before the Court 31 Criminal Municipal in Bogota, acting as Supervisory Court, Liliana Marcela Castillo Borja accepted charges of aggravated and extenuated kidnapping of a 17 months old girl in the South of Bogotá.
Last January 9, Castillo Borja accepted having fled with the newborn from a cafe located opposite the Hospital Meissen in the South of the capital, hiding from the authorities about 4 days.
The Supervisory Judge refrained from imposing a precautionary measure against Castillo Borja considering that she did not act in order to ask money for the minor releasing, nor sought to enslave her, but based on the arguments of the parties, it was the way to substitute the loss of her child during pregnancy which could result in emotional problems.
The judge recalled that because it deals with a felony and the victim being a minor, there will be no discount benefits of the sentence, by accepting charges.
The prosecutor’s office appealed the Supervisory Judge determination, which will be resolved in the coming days by one of Presiding Judge.
