Before a Human Rights and IHL prosecutor,  the accused MauricioVargas Ridaurde was agreed to accept the charges for co-responsability of homicide in protected person, forced disappearance and rebellion offenses.

On September 6, 2002, based on investigation, members of the 48  Farc Front kidnapped by force to Fredy Hernando Martínez and Alfonso Orlando López Toro, members of the community council in Peñas Coloradas, Puerto Leguízamo municipality, Putumayo department.

Subsequently, relatives of the victim knew that Martínez was shot by rebels. The whereabouts of López Toro is unknown.

Vargas Ridaurde who is imprisoned in La Picota prison- Bogotá, was agreed to plea bargaining and could be granted a reducing sentence up to 50 percent of the ruled conviction by the Presiding Judge.
