The arrest of the defendant \u00c1lvaro D\u00e1vila in a care center in Bogota has been reported tonight by the Colombia\u2019s Attorney General, Eduardo Montealegre Lynett.\u00a0 “Unjustified delay” is an Obstruction of Justice and “by sufficient merit”, the imposition of a remand in custody against D\u00e1vila will be requested. Argued the senior official.<\/p>\n
The Prosecutor\u2019s Office has evidences, material elements and testimonies to accuse lawyer D\u00e1vila for counts of bribery, conspiracy to commit crimes and illicit interest in contract celebration, pointed out the head of the accusing entity, by explaining to journalists and reporters about the arrest authorized by a Supervisory Judge.<\/p>\n
Likewise, after thorough analysis, the Colombia\u2019s Attorney General Office concluded that it was urgent the exceptional arrest of the person above mentioned in order to carry out a hearing to lay charges and to request a restrictive measure of freedom, affirmed the senior official who was accompanied by Deputy Assistant Attorney General, Jorge Fernando Perdomo Torres and the Director of the Technical Investigation Team (CTI), Maritza Escobar.<\/p>\n
Davila was clinically evaluated by two doctors from the National Institute of Legal Medicine and Forensic Sciences in order to establish whether or not he is in condition to be imprisoned in a detention center. Attorney General also reported.<\/p>\n
If Davila is not in health conditions, a Supervisory Judge will be requested by the Attorney General Office to move to the clinic where the defendant is. So in that place, after the accusation hearing can be carried out, the judge will decide whether or not ruled the detention in custody, said the Attorney General who stressed that such a procedure is allowed by law.<\/p>\n
Regardless of his health condition, he was already arrested by CTI and the justice will continue with the accusation hearing and the request of precautionary measure, concluded the Attorney-General.<\/p>\n
In turn, Deputy Assistant Attorney General, Perdomo Torres, has motivated defendants and lawyers to be present in hearings.<\/p>\n
